World Data Privacy Day 2020: Celebrate with Compliance

Today is World Data Privacy Day, an international event aimed at raising awareness about data privacy and protection. At Bond, we are participating by prompting dialogue about changes in the legal landscape of data privacy, encouraging compliance efforts, and promoting best practices for the protection of data privacy. The cybersecurity and data privacy attorneys at Bond have been counting down the days to World Data Privacy Day by highlighting different data privacy laws such as the California Consumer Privacy Act (CCPA), the Clarifying Lawful Overseas Use of Data Act (CLOUD Act), the New York’s Stop Hacks and Improve Electronic Data Security Act (NY SHIELD Act), the Health Insurance Portability and Accountability Act (HIPAA) and the Gramm-Leach-Bliley Act, among others, all available at this link.

With the enactment of the General Data Protection Regulation (GDPR), the CCPA, and the NY SHIELD Act in the past several years, and with more and more states introducing distinct yet similar laws, it is clear that data privacy legislation is here to stay. Given the digital nature of the modern world, data privacy and security are relevant to all people and businesses. Laws such as the GDPR and CCPA recognize data privacy as a personal right. These laws are changing the way businesses think about, and use, data.  

In recognition of World Data Privacy Day, it is an ideal time to first, identify the type of electronic data your organization collects, stores and/or processes, and next, determine whether you have an appropriate data security policy in place to determine whether you are at or nearing cybersecurity compliance. This undoubtedly raises a threshold question of what cybersecurity laws or regulations control your company’s data, and the answer to that question may not be obvious.
